By using the service provided by Commu (Ronsam Digital Oy, Business ID: 3168016-8, hereinafter also “Commu”) you accept these Terms of Service (“Terms”) and agree to comply with them. Please read the terms described below carefully before using the service.

General

“The Commu service” or “the service” refers to the digital application offered by Commu to natural persons and legal entities, Commu’s website (commuapp.fi), and other related services provided by Commu.

Using the Commu service, or any part of it, requires that the User has first read, understood, and accepted the contractual terms formed by these Terms of Service. By accepting the Terms of Service, registering as a Commu user, downloading the service’s application, or otherwise starting to use the Commu service, you confirm that you have understood and accepted these Terms of Service.

Commu reserves the right to make changes to the Terms of Service. If the Terms are changed, Commu will announce the changes made at the end of the Terms, stating the date on which the change was made. Updates to the Terms of Service take effect at the earliest when:

  • Seven (7) days have passed since the change; or
  • You use the service for the first time after the change to the Terms of Service.

If you do not accept the Terms of Service, you do not have the right to use, or be involved in the use of, the service. By starting to use the service, you accept and understand that you do not have a right of withdrawal for a service already performed. If you wish to terminate the agreement formed by the Terms of Service, you must immediately stop using the Commu service and delete the application downloaded to use the service, as well as your user account.

In addition to the Terms of Service, Commu has separate community guidelines in force. As a user, you agree that you are aware of the community guidelines in force at any given time and that you familiarize yourself with any changes that may be made to them. The community guidelines are a living document, and Commu may update them more freely than the Terms of Service, provided that, at the latest when using the application, the user is notified of any new changes to the community guidelines.

In addition to these Terms of Service, the use of applications that enable the use of the Commu service, such as mobile and tablet applications made available to the user in the Apple App Store, Google Play, or through another service provider, is also subject to the terms of that service provider.

Registration

By registering with Commu, you accept the terms described in this document and agree that the conditions listed below are met.

  • You are at least 15 years old OR you use Commu only under the supervision of a guardian.
  • The information you provide is accurate and correct.
  • You understand that you, and only you, bear full responsibility for your own account, for content created with it, and for actions taken through it.
  • You understand that you are responsible for keeping your account secure. You are responsible for ensuring that your password is sufficiently strong and that no other person has access to your device or email, etc.
  • If harmful or damaging activity is carried out through your account, we may hold you liable for it.
  • You understand that you may have only one account.

Registering with Commu under a false name, or with an email address that is not your own personal email address, is prohibited.

Interaction with other users

You are solely responsible for your interactions with other Users, regardless of whether the interaction takes place online or in person. You agree to take reasonable precautions in all interactions with other Users.

You agree to comply with the community guidelines in force at any given time and the rules set out in them for interacting with users.

You acknowledge that Commu does not, as a general rule, verify the actual identity of Users or the content that Users add to Commu, and that Commu has neither the obligation nor the ability to guarantee that another User is who they claim to be. Commu is not responsible for content added to Commu by third parties, such as other Users, or for damages arising from the use of such content. You understand that the information Commu provides about users is intended only to support your own decision-making, and does not constitute any promise or guarantee of anything.

You agree to release Commu from all liability or damage arising from the behavior of a User (including you) when using the Commu service. The aforementioned release from liability covers any type of direct, indirect, special and/or incidental and other similar damages, including financial losses, property damage, personal injury, emotional distress and/or other damages that may arise from communication, interaction, agreements, or other behavior with other Users or other persons that you encounter while using the Commu service.

Note, however, that you may have the right to request evidentiary material from Commu in a situation of the kind described above. More on this in the section Responsibilities, Rights, and Obligations.

User’s responsibility for personal data

You agree that the information you provide about yourself is up to date, truthful, and does not contain offensive or unlawful material. Unlawful material also includes, among other things, materials protected by copyright.

Creating listings on Commu

By creating a listing, you agree that the information you provide is accurate and truthful, that it is in the correct category, of the correct type, and that its content has not been written in a misleading way. You agree that your listings are current and that you are prepared to receive communications from users related to your listing, as well as prepared to provide or receive the service mentioned in the listing. When creating a listing, you must be aware of the community guidelines in force at the time and you agree that you will not violate these rules and that your listing does not contain anything prohibited under the community guidelines.

As a Commu user, you are fully responsible for your listings and their content. Commu does not assume responsibility for the content of listings.

We reserve the right to investigate and take appropriate legal action against a user who, in Commu’s sole interpretation, violates these provisions. This may also include reporting such actions to law enforcement authorities.

Acting under an organization account

Commu allows a user to belong to one or more organizations. Among other things, this allows the user to give themselves a different display name and picture when acting under the organization. Listings created in this way are also displayed differently.

Belonging to an organization is voluntary for the user, and when joining and acting under an organization, the user accepts that the organization’s administrators can see the information in their Commu profile, their usage history under the organization account, and the listings they have created under the organization. The user accepts that the intellectual property rights to content they create under their organization account are, as a general rule, owned by the organization and not by the user themselves. An exception to this is the conversations the user has in the application, to which the organization has no rights. The user may, however, transfer ownership of their own listing to another user within the same organization. In that case, the previously conducted conversations also transfer to the new owner. However, the user is not released from the obligations and responsibilities concerning them, even if they act under an organization and the organization owns the content created.

Service interruptions and technical malfunctions

Commu is not liable for damages resulting from technical faults, maintenance work, updates, interruptions in the telecommunications network or the Internet, or other possible circumstances. Commu does not guarantee the retention of stored data and is not liable for damages that may result from data being altered, lost, destroyed, or deleted. We continuously develop Commu to better meet users’ needs, and changes may also affect the Terms of Service.

Responsibilities, rights, and obligations

You understand and accept the following:

  • Finland has freedom of contract. This means that matters you agree upon with another user may be interpreted as an agreement under Finnish law between you and the other user or users, of which you and the other user(s) are the parties. A legal claim may arise from an agreed matter in accordance with Finnish legislation on contracts.
  • Commu is not responsible in any way for agreements between users and is not a party to them. Commu has no obligation to compensate, reimburse, or otherwise participate in possible dispute situations.
  • A Commu user has the right to request evidentiary material from Commu, if necessary, to resolve their own dispute. The right to information applies only to information in which the user is involved. Commu reserves the right to decide what information is disclosed to users. Commu has an obligation to process a request for information within 30 days of receiving the request.
  • Commu is not responsible for the quality of work performed and is not liable for any resulting damages.

The creator of a listing is responsible for:

  • The legality of the listing
  • Ensuring that the listing does not violate the Terms of Service
  • Ensuring that the listing does not infringe copyright
  • Providing the services agreed upon with another user

The creator of a listing has the right to:

  • Edit or delete the listing
  • Advertise their own listing in other media

The party responding to a listing is responsible for:

  • Providing the services as agreed
  • Ensuring that they do not violate the Terms of Service
  • The truthfulness of their messages

The party responding to a listing has the right to:

  • View the messages they have exchanged
  • Have messages that do not infringe copyright

Commu has the right to retain information related to listings and conversations even after they have been edited or deleted.

The user is fully responsible for handling their own tax matters, should they accrue a benefit through the service that the tax authority considers taxable. The user is also responsible for complying with laws relating to work and employment.

Consequences of violating the Terms of Service

Commu has the right to lock or delete a User’s account if the User violates their obligations under these Terms of Service (for example, by sending messages on Commu that violate the Terms, using the Service contrary to good practice, or otherwise).

Commu has the right to close or delete any user account based on mere suspicion that this agreement has been violated.

Disputes between users

Users are encouraged to primarily resolve disputes between themselves through negotiation. Users acknowledge that resolving a dispute between users is entirely the users’ own responsibility. Commu is not a party to a dispute between users. However, Commu may, if necessary, contribute to resolving a dispute by providing information about the content of a listing or conversations, in order to help reach a settlement in the dispute. You understand, however, that Commu is not responsible for resolving disputes or for furthering their resolution.

Commu, as a third party, is not liable for costs arising from a dispute between users, such as legal fees and other litigation costs.

Feedback

Feedback is important to us so that we can make Commu even better. We welcome development suggestions, comments, and praise alike. You can reach us by email (company@commuapp.fi), through the Commu mobile application, or by other means of communication. Commu receives, free of charge, the copyrights and other intellectual property rights related to the feedback we receive. As the provider of feedback, you acknowledge that the feedback we receive is considered Commu’s property and non-confidential. Unless otherwise required by the restrictions on the use of personal data set out in Commu’s privacy policy, Commu may freely use and/or distribute submitted materials without restriction for any purpose.

Validity and termination

These Terms of Service are in effect from 1 February 2024.

These Terms of Service remain in force between Commu and the User for as long as the User uses the Commu service. The User may stop using the Commu service at any time. You may close your Commu account at any time by following the instructions available through the service. Termination of the Terms of Service does not release you from handling matters that have been agreed upon, since the agreement relating to them is between you and the other user.

Termination of the agreement also does not nullify terms which, by their nature, are intended to remain in force after the termination or expiry of the agreement. Such terms that remain in force despite termination include, but are not limited to, the sections of the Terms of Service describing liability, compensation, types of damages, data protection, dispute resolution, and protection of ownership rights.

Commu may permanently or temporarily discontinue offering the Commu service at any time and for any reason. When the provision of the service is interrupted or ends, the User no longer has the right to use the service.

Intellectual property rights

Commu obtains full usage rights to all material that you, as a user, upload to the application. As a user, you must accept the possibility that your public information may also be reused. “Public information” here refers to information that other users can access within the application without any active action on your part being required.

Commu does not use your information or material for resale purposes. As a user, you also retain the intellectual property rights to your materials.

If you wish to use Commu’s logo or other similar material related to the brand or visual identity, you must first contact us and request permission for such use. However, you may share screenshots of the application without separate permission.

You may not use any data mining, robot, scraping, or similar data collection or extraction methods to obtain service content. No part of the Commu service may be copied, reproduced, modified, duplicated, distributed, republished, uploaded, transmitted, republished, or sold in any form, in whole or in part, or by any means, except as expressly and separately permitted in the Terms of Service. The service may only be used by means expressly approved in the Terms of Service.

Privacy

Commu acts as the data controller referred to in the Personal Data Act. Commu may collect and process the User’s personal data to the extent required by the use of the Service.

Commu processes users’ personal data in accordance with the privacy notice, data protection legislation, and the terms of the privacy policy. Commu’s privacy notice and privacy policy are available at commuapp.fi/tietosuoja/. By using the service, you accept the terms of the privacy policy.

Applicable law and disputes with Commu

These Terms of Service are governed by the laws of Finland, excluding its conflict-of-law provisions. These Terms of Service have been drawn up in accordance with Finnish legislation.

Commu always strives to resolve disputes concerning the Terms of Service or the service through negotiation. If no negotiated settlement is reached regarding the subject of the dispute, all disputes between Users and Commu arising from these Terms of Service shall be finally settled by arbitration in accordance with the rules of the Arbitration Institute of the Finland Chamber of Commerce, with one arbitrator. The seat of the arbitration shall be Helsinki, and the language of the proceedings shall be Finnish. Unless otherwise required by applicable law, each party shall bear its own legal costs, regardless of which party is considered the prevailing party in the arbitration.

Other terms

This agreement was originally drawn up in Finnish. If any translated version of this agreement conflicts with the Finnish-language version, the Finnish-language version shall take precedence.

These Terms of Service constitute the entire agreement between Commu and you, superseding any prior discussions and correspondence between the parties concerning the services.

If any part of these Terms of Service is deemed invalid or unenforceable, that part shall be amended to conform to applicable law in a way that reflects as closely as possible the parties’ original intentions, and the remaining parts shall remain in full force.

If Commu does not exercise any right under these Terms of Service, this does not constitute a waiver of that right or of any other right.

When interpreting the Terms of Service, the content of the Terms of Service shall take precedence over their headings. The contra proferentem rule of contract interpretation shall not be applied to the detriment of the drafter of the Terms of Service. The User has an obligation to carefully review the content of the Terms of Service before accepting them. The Terms of Service have been drawn up for the benefit of both Commu and the user, as they establish and clarify the rights and obligations of the parties.

You agree to comply with all local, regional, and national laws, regulations, orders, and rules when using the Commu service.
